1. General Provisions

1.1 This document defines the general terms and conditions for the provision of cosmetology services by Justyna Broda, operating under the business name “Justyna Broda Kosmetolog,” with tax identification number (NIP): 6783020498.
1.2 For the purposes of this document, the following terms written in capital letters shall have the meanings assigned below:
1.2.1 “Beauty Plan” – a consultation between Justyna Broda and the Client regarding the Client’s issues and needs, aimed at tailoring a treatment plan suitable to the Client’s problems and needs, along with recommendations for personal care.
1.2.2 “Price” – the cost of one or several services provided by Justyna Broda Kosmetolog to the Client during one or more Appointments, as agreed upon by the Parties.
1.2.3 “Studio” – the cosmetology studio “Justyna Broda Kosmetolog,” located in Kraków at ul. Rakowicka 15/1, 31-511 Kraków, and the Studio in Warsaw.
1.2.4 “Studio in Warsaw” – the cosmetology studio “Justyna Broda” in Warsaw, at an address provided to the Client by Justyna Broda.
1.2.5 “Justyna Broda” – Justyna Broda, conducting business under the name “Justyna Broda Kosmetolog,” based in Kraków at ul. Rakowicka 15/1, 31-511 Kraków, with tax identification number (NIP): 6783020498.
1.2.6 “Client” – an individual using the services of Justyna Broda under an Agreement concluded with her.
1.2.7 “Terms and Conditions” – this document, including all amendments and annexes thereto.
1.2.8 “Online Appointment Booking” – the arrangement between the Client and Justyna Broda to set an exact date and time for an Appointment.
1.2.9 “Parties” – collectively, the parties to the Agreement: Justyna Broda and the Client.
1.2.10 “Services” – cosmetic services and cosmetic consultations, including holistic consultations, provided by Justyna Broda to the Client under the Agreement.
1.2.11 “Agreement” – the framework agreement for the provision of Services established by these Terms and Conditions and concluded between Justyna Broda and the Client.
1.2.12 “Appointment” – each in-person meeting between Justyna Broda and the Client at the Studio, intended for the provision of Services to the Client.
1.2.13 “Voucher” – a document issued by the Studio, entitling its holder to use services available at the Studio within a specified period (limited validity). Vouchers are issued either in physical or online form and may be personalized or bearer instruments. A Voucher is not a payment method and cannot be exchanged for cash.
1.2.14 “Prepayment” – an advance payment made by the Client upon Booking or Online Booking of an Appointment.
1.3 Terms defined in these Terms and Conditions may be used in singular or plural forms as appropriate to their meaning.
1.4 All communication, including declarations regarding cancellations or modifications of Appointments by the Parties, as specified in these Terms and Conditions, must be made in digital form via WhatsApp or SMS.

2. General Principles of Justyna Broda’s Operations

2.1 Services are provided by Justyna Broda in person at the Studio.
2.2 By booking the first Appointment, the Client accepts the Terms and Conditions, which enables the Client to schedule Appointments and use Services in accordance with these Terms. The acceptance of the Terms and Conditions (conclusion of the Agreement with Justyna Broda) without scheduling an Appointment does not obligate the Client to use the Services or book Appointments, nor does it result in any financial obligations for the Client. Acceptance of the Terms and Conditions establishes a framework agreement between the Parties, setting out the terms for any future provision of Services during individual Appointments.
2.3 Booking the first Appointment by the Client is equivalent to accepting the Terms and Conditions, as provided to the Client in accordance with point 1.4.
2.4 In cases agreed upon between Justyna Broda and the Client, Services related to consultations, advice, or monitoring of cosmetology therapy may also be provided remotely via telecommunication tools, particularly videoconferencing. The choice of communication method is at the discretion of Justyna Broda, depending on current needs and the feasibility of providing the Service remotely. The price for online consultations or follow-up consultations is paid in full via bank transfer or through the website prior to the provision of such remote services. This payment is non-refundable; however, the appointment may be rescheduled in accordance with the Terms and Conditions.
2.5 The Client is obligated to follow the recommendations of Justyna Broda regarding personal care, nutrition, recommended substances and cosmetics, consultations, medical examinations, and other activities. Justyna Broda is not liable for any consequences resulting from the Client’s failure to comply with these recommendations.
2.6 All Services are provided exclusively by Justyna Broda personally.

3. Acceptance of the Terms and Conditions

3.1 A prerequisite for the provision of Services to the Client is the acceptance of the Terms and Conditions. Acceptance occurs when the Client books their first Appointment. The Terms and Conditions are sent by Justyna Broda via SMS or WhatsApp in the form of a link directing the Client to the content available on the website, and the Client is obligated to familiarize themselves with the Terms and Conditions.
3.2 The Terms and Conditions are available to the Client:
3.2.1 In electronic form on the website via the link provided by Justyna Broda in accordance with point 3.1.
3.2.2 On a dedicated notice board in the Studio.
3.3 The Client accepts the Terms and Conditions digitally after they are sent by Justyna Broda. The act of making the first Appointment Reservation after receiving the Terms and Conditions and paying the Prepayment for that Reservation constitutes acceptance of the Terms and Conditions by the Client.
3.4 The Client additionally confirms acceptance of the Terms and Conditions by completing a personal questionnaire during their first Appointment at the Studio.

4. Appointment Rules

4.1 Justyna Broda provides Services only after the Client has made an Appointment Reservation.
4.2 Appointment Reservations can be made by the Client via phone, digitally, or by SMS.
4.3 Justyna Broda will confirm each Appointment by sending the Client, via the website www.justynabroda.pl, SMS, or another agreed method, the Appointment details, the Prepayment amount, payment methods, and payment details, as well as a link to the Terms and Conditions in accordance with point 3.1.
4.4 An Appointment Reservation is considered confirmed once the Client has made the Prepayment toward the Services scheduled for the Appointment. The Prepayment is no less than 150.00 PLN, with the exact amount determined by Justyna Broda during the Appointment Reservation.
4.5 The Prepayment can be made:
4.5.1 To the bank account of Justyna Broda at Mbank, account number 67 1140 2004 0000 3302 7743 1523.
4.5.2 Via BLIK transfer to the phone number 500 486 442 or through the online booking system available at www.justynabroda.pl, as specified by Justyna Broda in the message mentioned in point 4.3.
4.5.3 Through the online booking system available at www.justynabroda.pl.
4.6 The Client must make the Prepayment within 24 hours of receiving the Appointment confirmation from Justyna Broda via SMS, including the Prepayment details outlined in point 4.3. The Client must also send proof of payment (transfer confirmation or BLIK payment) to Justyna Broda. Failure to meet this deadline will result in the cancellation of the Appointment Reservation. For reservations made through the online booking system at www.justynabroda.pl, the Prepayment must be made at the time of booking.
4.7 Once the Prepayment is credited to Justyna Broda’s bank account, the Appointment is officially reserved for the Client, and a specific agreement for Services during the particular Appointment is concluded between the Parties.
4.8 If the final Price for the Services provided during the Appointment is lower than the Prepayment, Justyna Broda will promptly refund the difference to the Client at the end of the Appointment.
4.9 At her discretion, Justyna Broda may waive some or all of the requirements outlined in this section, informing the Client of such exceptions at the time of Reservation.
4.10 The Client is obligated to arrive at the Appointment on time.
4.11 If the Client is late for the Appointment, the duration of the Appointment may be shortened, and the scope of Services, including treatments, may be limited to ensure the Appointment does not interfere with the next Client’s scheduled time. The organization and duration of the shortened Appointment are at the sole discretion of Justyna Broda.

5. Service Prices

5.1 Justyna Broda communicates the Service prices during the Appointment Reservation and additionally during the visit at the Studio. Service prices are also available on the website: www.justynabroda.pl.
5.2 Service prices may change during the Appointment, depending on the treatments performed by Justyna Broda. Any price change requires prior acceptance by the Client.

6. Rules for Appointment Cancellation and Rescheduling

6.1 The Client has the right to cancel an Appointment Reservation or change the Appointment date to a new one, agreed upon with Justyna Broda.
6.2 The Client may cancel or reschedule the Appointment at any time under the following conditions:
6.2.1 Canceling or rescheduling the Appointment more than 48 hours before the scheduled time has no negative consequences for the Client. In such cases, the Prepayment is credited toward the next Appointment. Rescheduling can be done twice within 12 months from the date of the initial cancellation.
6.2.2 Failing to meet the 48-hour notice results in the Prepayment being forfeited, treated as a fee for canceling the Appointment. Canceling or rescheduling within 48 hours or less before the Appointment also results in the Prepayment being forfeited.
6.3 The rules concerning Prepayment in 6.2.2 also apply when the Client:
6.3.1 Fails to show up for the Appointment despite confirming the Reservation.
6.3.2 Arrives more than 15 minutes late unless Justyna Broda determines that the agreed treatments can be completed within the shortened Appointment time.
6.3.3 Interrupts the Appointment; if the value of Services rendered by the time of the interruption exceeds the Prepayment, the Client must pay the difference.
6.4 Justyna Broda may, at her discretion, waive any or all of the requirements in point 6, informing the Client of such waivers at the time of Reservation.
6.5 Justyna Broda reserves the right to cancel an Appointment at any time before the scheduled time. If the cancellation occurs within 2 days or less before the Appointment, the Client’s Prepayment may, at their choice:
6.5.1 Be credited toward the next Appointment Reservation, with the Client receiving an additional 10% discount on the total Service price during the next Appointment.
6.5.2 Be refunded via bank transfer to the account specified by the Client within 3 business days from the cancellation by Justyna Broda.

7. Special Service Rules

7.1 As part of the Services, Justyna Broda provides the Client with a Beauty Plan.
7.2 The Beauty Plan is included in the Service and its cost is part of the prices for treatments and cosmetics sold to the Client (the Beauty Plan is not additionally charged).
7.3 If the Client receives a Beauty Plan during the Appointment but does not use at least one treatment or purchase at least one set of recommended cosmetics during the first Appointment, the Client is required to pay 200.00 PLN for the Beauty Plan.

8. Specific Rules for Services in the Warsaw Studio

8.1 The provisions of the Terms and Conditions apply to Services provided in the Warsaw Studio with modifications as outlined in this section.
8.2 The Prepayment for Services reserved in the Warsaw Studio is non-refundable due to additional costs incurred by Justyna Broda for providing Services in Warsaw, except in cases of cancellation by Justyna Broda under point 6.5.
8.3 If the Client cancels a Reservation in the Warsaw Studio:
8.3.1 More than 7 days before the Appointment, the Prepayment is credited toward the next Reservation in the Warsaw Studio. If no Reservation is made within a month, the Prepayment is forfeited as a cancellation fee.
8.3.2 Seven days or less before the Appointment, the Prepayment is forfeited as a cancellation fee.

9. Vouchers

9.1 These Terms and Conditions define the rules for the sale and redemption of Vouchers at the Kraków Studio.
9.2 By purchasing a Voucher, the Buyer acknowledges they have read, understood, and agreed to the Terms and Conditions.
9.3 Vouchers must be redeemed at the Kraków Studio.
9.4 The Kraków Studio is not responsible for lost or damaged Vouchers after they have been delivered to the Buyer.
9.5 The Buyer must reserve services in advance following the rules outlined in the Issuer’s Website Terms. To redeem a Voucher, the Buyer must present it or provide its unique number.
9.6 Each Voucher has a unique identification number.
9.7 The Voucher’s validity period is indicated on it and is valid for 3 months from the date of purchase. Appointments must be scheduled and the Voucher redeemed within this period. Extensions may only be granted in exceptional cases, at the sole discretion of the Kraków Studio.
9.8 Vouchers may have restrictions on appointment availability depending on the Service type.
9.9 If the service price exceeds the Voucher value, the Buyer must pay the difference.
